What are the legal requirements before a gift is valid?

If the donor delivers a deed stating the gift to be transferred does legal title pass on the delivery of the deed? Please include sourses, statutory or otherwise.

Possession of the gift property, a valid tranfer deed free of encumberance duly recorded signed by all property owners.

Reply:It needs to be recorded with the county recorder before it is considered transferred legally.

Reply:In the UK, law relating to gifts is much the same as creating a valid trust. 3 certainties need to be fulfilled, Certainty of intention (is it certain that the donor intended to give the gift), certainty of subject matter (what the gift is meant ot be is certain) and certainty of objects (person[s] who are to receive the gift) as long as that is all gravy there should be no problem as you say it has been done by deed. If it wasnt it would matter if it was a gift of land or of personalty.
