How long after January 1 can I make a charitable gift and take a tax deduction for the previous year?

If I am an individual taxpayer and I decide to make a charitable gift after January 1, 2007, can I deduct that from my 2006 taxes? and if so, how long into 2007 do i have to make that charitable gift?

As a rule, you can't. there was a one-off dispensation for the Asian Tsunami a couple of years ago.





What you can do is mail a check on 31st December and claim that. Just make sure the charity acknowledges that the check and postmark were dated December and not January.

It was extended to 1/31 of the next year after the Indian Ocean Tsunami as it happened so late in the year but that was for that year (2004) and only for contributions for Tsunami relief.





One option though is to put it on a credit card. If is on a credit card by 12/31/2006 you can deducted it for 2006. This is the only way to get a 2006 deduction and pay for it in 2007.
Reply:If you are audited for 2006 and the checks to charities show the charity deposited them in the first week or so of January 2007, you will probably withstand the challenge. If the bank pay dates are after say, January 10th, you may be asked to provide some kind of explanation from your bank. After January 20th, expect the agent to disallow the deductions for 2006.

I think it depends on the personality of your child. What does he like? Some children love to attend live children's concerts. Some love picture books. There are some good learning video cassettes like "Baby Einstein" or "Baby Mozart" series. There are children's version of laptop computers. Some children like attending special children's workshops, for examples, art %26amp; craft, music, dancing, sports, gardening, drama, photography etc. There exist a lot of workshops that offer free trial sessions that you may like to consider.





A trip to a place of interest also might be appealing to your child.





Personally, I would buy what my child finds "cool".





Most importantly, I'm sure you have already prepared for him a day filled with joy, laughter, and loving memories.

Reply:I would suggest Lego, the large ones for young kids. As he gets older you can buy the smaller ones which can be used with the large ones. There are heaps of different designs you can get and you can just add to them over the years. Creative and clean, but horrible when sucked up a vacuum cleaner!

There are so many gorgeous hardcover books for children with such amazing pictures that the child will have a hard time NOT falling in love with reading!

I just went through this with my hubby 1 week today in fact. Depending on how much you can spend, I have a few suggestions : Solar powered watch ( G-shock makes a great one, about $80 ) , a psp if he doesn't already have one ( it's small and won't be a hassle to lug around, $169 ), Go have a friend take pictures of you two before he leaves, a flash light with colored filters like red, if he likes to read a few books to get him started ( you can always send more ), envelopes pre-stamped and with your address, last but not least send him away with a promise of your undying love.





Hang in there girl. Things will be rough at first but I promise things will get easier as the days go on. Know that he is thinking of you just as much as you are of him.

Otherwise the best gift you can give him is certainly your unflinching support. Not just with him but with his family and friends. Be attentive at what you say about the things at home when hes there, the little things mean a lot more. And regardless of if you can get to see him online or not write often and send things like pictures of family or just you. I carried a picture of my wife and I over my heart the whole time I was there. Its a good feeling to know that when you do stop moving and your thoughts wander you can reach into your pocket and pull out that picture. It is a huge morale boost.


Send him off with a swagger or a stagger. :P I had the luxury of both.

If you are giving out a gift card for a specific city, make sure the card can be used in that area. For example, I live on the south coast of Oregon. We have 1 Starbucks (in the hospital), few major retailers (no Target, no Home Depot or Lowes, no Office Depot, no Olive Garden or similar restaurants, no Borders or Dalton bookstores). So getting a gift card from one of these vendors wouldn't attract many people to participate in the promotion.





What we do have (so would be more likely in 'any' city) - Walmart, Kmart, JC Penney, McDonalds. Another option is a card that can be used online - these can be used anyplace in the US.





My personal favorite card - Either a American Express, DiscoverCard, JCPenny or Amazon giftcard.

I'm studying my notecards about the taxes and I have that written down. Its next to impossible for me to try and find the sentence on that subject in my book as there are a lot of pages on these 2 taxes.

I think what you probably meant is this: when you figure the amount of a gift, you DON'T include that tax you are going to pay on it, so there is no tax on the tax. On the other hand, when your figure the estate tax, to DO figure it on the entire net estate--you get no deduction for the amount of estate tax you will pay. So you do pay tax on the tax.





For example, if the tax rate were a flat 50%, and all your unified credit is consumed. If you gave a $2 million gift, you would pay $1 million tax. You are out of pocket $3 million. Taxes ate 1/3, and your beneficiary got 2/3. If, on the other hand, you died with $3 million, you'd pay 1.5 million in tax, and your heirs would only get the other 1.5 million. So, while the stated rate of tax is the same, you pay more with an estate tax than with a gift tax.

The Inland Revenue has online guidance at the following webpage. I don't believe that members' subscriptions can be treated as though they were donations, but the Inland Revenue will be able to advise you.

Reply:Definately check the link to the Inland revenue that's already been given. Your charity should already be registered with HM Revenue and Customs as a charity for tax purposes and you'll have a reference number (different to your registered charity number) When they issued that number they would have included the forms neccessary to claim back gift aid. There are two forms, one listing the donations and one detailing the total amount claimed, and the claim can be sent in at any time although they request you wait til you have £100 due.





If members subscriptions can be treated as Gift Aid (which as I recall is complicated, and depends on what they "get out" of being members, I didn't go far into it when setting up ours as our membership is free) you'll need to get members to complete a Gift Aid declaration, allowing you to claim gift aid on their subscriptions and donations. The Inland revenue website will have details of that, and a proforma declaration you can edit for your charity.

Reply:I've had this problem and solved it by giving the bride a picnic basket, one that contains all the makings for a picnic for 2 or 4 people -- plates, utensils, napkins, wine glasses. I've even added a bottle of wine, candles, and tapas spreads. If you get the one for two people, it's a very romantic gift; the one for four people may be more practical if the bride likes to entertain. It's always been a big hit at every shower.

My two teenagers each got a mini-fridge for Christmas a couple years ago. From "Santa" - he put one of those huge bows on top and that's all. Inside the fridge was some ketchup, mustard, mayo, and a couple pieces of tupperware.





If regular wrapping paper is too flimsy, go to the dollar store and find a heavy table cloth to wrap it up.





To be silly, get about 3-4 different wrapping papers and just tape them all on randomly and torn-up/sideways as if a 4-year old did the job. Then get different ribbons and wrap around and around from all directions and top it off with a bottle of ketchup tied up and hanging off one side.

Most of us here are dedicated crafters, which means we prefer to create our own things. It just looks nicer that way, and of course one of a kind. But people who prefer shopping over crafting might like it.

Reply:eh, no, not like you're describing. I can buy cute patterned tissue paper at Target for a very fair price; even my Costco has some drop dead gorgeous specialty bows and paper this time of year. Yeah, I've bought them and it does make it sort of fun to make a present extra special with a special tag (again, set from Costco) or bow, but I couldn't imagine going out of my way to pay high prices for the giftwrap. Maybe I'd pay to have someone else wrap a gift, but a lot of places do that for free anyway. I've found darling ribbons at Michaels or Hobby Lobby on sale that make very nice package wraps. I think people notice things like real cloth ribbon vs. plastic curling ribbon.
Reply:I always use printed tissue paper and some bold colored ones as well, gift bags are great to fit just about anything into, and easier for some people to open, I like making my own gift tags using ribbon, raffia and dried flowers depending on the occasion. Reply:My personal experience with colored tissue papers is that too often the colors "run" when the paper gets wet. I figure wrapping should enhance as well as conceal a gift, rather than have potential for diminishing the gift's value. I've had the same problem with some ribbons.





Accordingly, I only use color-fast wrapping materials.

If you can stock a range in a simple scheme, paper, ribbon, tag and embellishments you might sell me some (if I did not live half a world away,) but I would not buy printed ribbon nor pre-shaped bows for printed decorated paper.





When I do buy in a gift wrapping shop, it is mostly to use the materials for different crafts, not for wrapping gifts. So contemplate selling materials for different crafts or just selling in such a way that people do not (always) have to buy a complete line if they only want one part of it.

I decided against this one because of several reasons at stated below:





Too Hard to Ship


Too Costly to Ship


Not enough of a Profit (hard to cover cost of doing business like location, utilites, advertising, items for baskets etc)


Items that go into baskets are costly and you can not skimp on amount you put into the baskets or you will not get repeat business. You have to buy in BULK and then you have to sell many baskets to cover it.


People are Pickey with these Gift Baskets


Cost Money to deliver (gas, time, car wear and tear) and most people want them delivered.


Location is the most important and so is Much advertising.





When you realize you only get $10-$50 for most baskets it is hard to make a decent profit to cover business costs and make money too.


Most people who start these shops have a sideline with it like candy, flowers, toys.


Of course, you have to like it and make an attractive basket set up. I have been doing that for years and enjoy that part but it is time consuming too.





Other ideas for businesses that are similar:

When shipping a gift internationally, does the customs form stay on the package when received?

I am sending my girlfriend a couple of gifts for her birthday, and was curious how the customs form works. As you may know, you have to list the package's contents and their respective values, which I did. My question is, does this stay on the package when she will receive it, or is it covered up? I ask because it kind of defeats the purpose of sending a gift if so, as its contents are displayed on the outside of the box, along with the value.

Reply:In traditional Chinese culture, many customs relating to prengnacy serve to protect the pregnant woman and child from 'bad influences' and to avert problems such as miscarriage, stillbirth, death of the mother and imperfections in the newborn. Many in traditional society actually blame the mother for deformities in the newborn as they feel she must have done something to cause the defect.





You might keep this in mind if it was a later miscarriage. Be sensitive to how their culture might view the death of the baby. Reassure the mother all that you can - a sympathy card would be nice that reinforces the idea that "some things are out of our hands" and assures your thoughts and prayers for future blessings.

Although their is something called a traditional Chinese hamper, which is a bouquet of Chinese flowers, and i would try to find something that would make the sorrowing couple happy again. For instance, if they like to go to a play, or the movies, etc. get them seats or tickets to something of that nature to take their mind off of the loss of their unborn. I truly hope that you accept my sincere apologies for your friend, and wish you the best on trying to find a proper gift for them. It is a hard thing to do---- find the right gift for someone..... If you're really good friends, she is bound to remember your gift. I'd get her quite a few things, and $50 can do just that!





I'd get things that STAND OUT. Example, clothes blend in with everything- there is a lot of clothing. But you only need one infant bath tub. I remember my infant bath tub gift the most.





I used it a lot, and when I got it as a gift, it was full of other useful things. I would definitely do a unique gift, not clothing.





So, in my infant tub (the tub was used as the basket).. I got a rubber ducky that said if the water was too hot, a 4-pack of washclothes, 2 hooded towels, and a 4-pack of soap/shampoo/lotion stuff.





It's really up to you, but seriously don't stress over it. Have fun with it ~ good luck

You can pick up a cheap basket in a cheap shop and then just fill it with bibs, baby powder / wash lotion, rattle, booties and other cheap things. We need to bring a gift to the Social Worker, Doctor, and President of the Adoption agency in Korea soon when we go there to get our new son. Honestly, a lot of people find some chocolate too sweet in Korea, at least, from my personal experience. Growing up in a Korean household, we didn't eat a lot of chocolate, and the coffee we had was the instant coffee that a lot of other people mentioned.





Something that is not available in Korea to the extent that it is in the U.S. is honey. I know, you're probably thinking that it's really weird. The thing is, a lot of honey in Korea is not authentic, it's hard to find 100% pure honey, even in the grocery store.





When we go to visit Korea, my grandparents especially like it if we give them jars of honey. We don't get regular honey either, if you live next to a farmer's market, it'd be great if you could go pick up some from there.





Also, how about something tourist-ey? If you're from a big city in the U.S. perhaps you can buy them a t-shirt with the name of your city or something of the kind. Even a snow globe or a little trinket that has the name of your city should be interesting and unique as well, leaving a little bit of yourself behind.

You can buy both from duty free on the airplane going over with your credit card - just remember there are limits on how much liquor you can bring in. Other ideas are US-made vitamins, candies, etc. Regular coffee is OK (many Koreans use instant coffee from little pouches), but don't take too much or Customs may question you.
Reply:I currently live in Korea, on an Air Base, and I have been for 3 years. I know that things that other people mentioned like designer bags, wallets, etc. they have a lot of, so I don't think that would fall under the unique area. Also, instant coffee is popular, but it's so popular that they already have it, so they don't really need it. I actually think that anything from America they would be happy with. I know that they actually do like whiskey or American alchohol or American Ham and honey, because it's something that they don't have. The type of ham in the metal type container. Also, I'm sure some type of meat that they do not have a lot of like ribs. My mother would always give our land lord ribs or ham and honey for holidays and stuff and one day the land lord came to our house and asked if we could buy her some of the ribs that we always gave her because her mother in law was coming over. To me, that shows she liked them. So maybe I suggest you get like a type of gift that they could display or something (any kind would probably suffice because it came from America) and then some type of maybe whiskey or meat.

Law text books are incredibly heavy, and 1Ls are required to haul a huge number of them around on a daily basis. Take a look at the High Sierra (link is below). No, I don't work for them -- but they offer a lifetime warranty. When I was a law student, I actually snapped the handle in half (hauling the bag, loaded with Law tomes, down NYC subway stairs). They replaced it for free.

My wife is the god parent of two girls. For each, we have started an "add-a-pearl" necklace. It isn't the cheapest gift in the world, but if you buy them 1 pearl for each occasion (B-days, christmas, and other events), by the time they are 18 or so, they should have a complete pearl necklace. There are several brands out there. We buy the 6mm pearls and they run in the upper $60's each. Each pearl comes on a card and at the end, you have to pay a small fee to have the necklace strung. Call local jewlry stores to see if they carry them. If you can afford it, if you buy multiple pearls at a time (with the jeweler I go to, they will do it for 4 pearls), you can get a decent discount...roughly 10%.

Reply:My son's Godmother bought him a Lenox train with his name and date of birth on it. Each year she will add a car. It is so adorable. The conductor is a giraffe. Lenox does not have a girly one. Reply:There are so many things out there that a child can love. I still have the bible that my great grandmother and grandmother got me when I was about 7 years old. It is a precious moments one. Although it is a bit tattered, 20+ years later I still have it and I won't give it up...of course it is in a safe place now and I don't use it, I wouldn't want it to be ruined. But a baby quilt might be just as good, prepare it then when the baby is born add some stitching to it that says baby's name, birth-date and time, and all that stuff.

However, you can give $12K to each parent each year and not have to file a gift tax return. You could give them $24K, and then loan them additional money, and then forgive that loan next year, at which time it becomes a gift.





Even if you give them more than $24K in one year and have to file a gift tax return, you almost certainly will not owe gift tax. The gift tax return keeps track of your lifetime gifts for purposes of computing estate taxes.

Perhaps a good way to go is to include yourself on the deed to the house as part owner and then ....you would actually benefit from the purchase tax wise and your parents would have their home.

I have never felt that giving pets as a "throw away" holiday gift was a very good idea, especially to very young children. They don't really know how to care for or properly handle a kitten or small puppy. Then after the novelty wears off, the poor animal is often mistreated or neglected, then thrown outside when the coldest part of the winter is settling in to starve or freeze to death. PLEASE - don't give pets as gifts, especially without consulting parents or guardians!

As for getting a pet for someone elses child without consulting the parent(s)... that's just CRAZY !

This was perfect for my litter. I ran the baby bumpers around the inside of the crate, under the tray and it kept my Shih Tzu pups safe and sound. It also gave me complete view and access to the pups at all times. (There are two doors to the crate.)

Reply:Well the most thoughtful thing that someone gave my dog was his "Grammie" she made him a quilt it was beautiful, and the nicest dog thing I ever got was my mother had a cake with my dog's picture on it made for my birthday, it was so sweet I cried, but I wouldn't let anyone eat his face I kept it in the freezer for like two years until it was covered in freezer burn and you couldn't even see his face any more LOL.

Reply:I can have some crazy vet bills owning 6 English Bulldogs, so my sister paid my vet $300.00 as a credit toward any future visits, that was better than any gift I've gotten. I think she did it because I had a vet visit back in Sept with my Boxer who was very sick and needed alot of things done including an I.V. drip. Unfortuntely he did not make it past that night and died on my family room floor, It was a Sat nite and my vet was closed till Monday, Not knowing what to do with him, I called the emergency clinic and they said they would take care of him until Monday when I could take him to my vet to have him cremated. Once I got over there with him I seen that they actually do cremation and had them go ahead (which was $50.00 cheaper than my vet) so I spent $300 at my vet and $210 for the cremation. Which I had the credit at that time..
Reply:Mine is kinda like Vet Tech's. A long time ago, my brother knew I was looking for a dog, and he told me about this lady he heard of that was going to euthanize some of her dachshunds because she wasn't using them for breeding any more (she unfortunately ran a puppy mill) and he told me I should go save one of them, so the next day, we went out, and I fell in love with the girl I got now. The lady just thought she was worthless at the time I got her because she already had several litters by three years old and didn't want her pups any more. She's priceless to me and I didn't pay a thing for her. I'm just thankful that my brother told me about her (and luckily she lost most of her dogs now) and although she has some social issues and needs to have surgery next week to repair a fairly big inguinal hernia before it ruptures, she still lives today (she just turned five yesterday!) and that's all I could ask for. She's a wonderful dog and that lady doesn't know what she's missing and she most certainly doesn't deserve the friendship of any dog after the terrible things she's done. For my other dachshund, her being at the shelter at the time she was was a gift for me. I had been looking for another dachshund for about three months, had been to several shelters, and had the disappointment of not meeting the right dog several times, but along came her! I took my other dog mentioned above the the shelter to meet her and they got along right from the get-go, we took a walk in their park (the shelter is huge and has its own dog park) and everything worked out great. I'm just happy that the shelter let me have the pleasure of making her a part of my family after she had been found roaming the streets, put in the pound, and then brought to the shelter.
Reply:Well, I guess I am thought of as the laughing stock of the town, walking three coonhounds on leashes around town(coonhounds are not usually kept as pets). . . and 3 at once? It's hard, but they are my kids.





But whenever I roll up to the drive-thru window at the bank to put my paycheck in, the tellers always have treats ready especially for my hounds. (They have treats for all doggie banking customers, but they always get ones that my dogs especially like for us.) I think it's so sweet that they remember my monsters.

My Saint was found in a black garbage bag with 8 other litter mates in a field by a good Samaritan. Her name was Claire and I named my Saint something very similar. That was my first gift.





My second gift was the woman who called animal control on my Newfs old owner. If it wasn't for that woman, I would not have my girl. My Newf too shares a similar name to the woman who called in the abuse case.





So, my Saint and my Newf are the two best gifts I could have ever asked for and I owe their lives to their two heroes.

There is one instructor that has been particularly helpful and inspiring to me throughout my education. I am set to graduate in May and would like to present him with something small yet meaningful in appreciation of him going out of his way several times to assist me in my studies. As a retired college professor I can tell you a sincerely written thank you note is about as good as it gets. However, even better would be if you send copies of that note to the department chair and to the dean and provost. Maybe mention his name to the committee that chooses the outstanding teacher each year. Every college professor needs that kind of documentation.


As far as a physical gift is concerned it would depend partly on his field. In many fields a book would be appropriate. In others perhaps some kind of tool he coud use in his work. One student gave me home made candy. Others gave me books. Another gave me a bottle of very good wine.


Don't give him anything until he has turned in his grades.
